These Terms of Service (“Terms”) govern your access to and use of TypingPlace, a typing practice platform operated by Eyal Lapid (“we”, “us”, or “our”). By accessing or using TypingPlace, you agree to be bound by these Terms.
1. Agreement to Terms
By using TypingPlace, and by creating an account if account features are offered, you
confirm that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding agreement
- You agree to comply with these Terms
If you do not agree to these Terms, you may not use TypingPlace.
2. Description of Service
TypingPlace is a typing practice platform that provides:
- Interactive typing exercises and lessons
- Performance tracking (WPM, accuracy, progress)
- Practice sessions based on the exercises currently available in the service
We may modify, update, or discontinue features of the service at any time. We will notify you of significant changes that affect your use of the service.
3. Account Registration
The current TypingPlace practice site is available without an account. If account
features are introduced or enabled, you agree to:
- Provide accurate and complete information during registration
- Keep your login credentials secure and confidential
- Notify us immediately if you suspect unauthorized access to your account
- Maintain only one account per person
You are responsible for all activity that occurs under your account if you create one.
4. Acceptable Use Policy
You agree to use TypingPlace only for lawful purposes and in accordance with these Terms.
Prohibited Activities
You may not:
- Use automated tools, bots, or scripts to access the service
- Scrape, mine, or extract data from the platform
- Reverse engineer, decompile, or disassemble any part of the service
- Attempt to circumvent security measures or access restrictions
- Share your account credentials with others if account features are enabled
- Impersonate another person or misrepresent your identity
- Use the service in any way that violates applicable laws
- Harass, abuse, or threaten other users or our staff
- Transmit malware, viruses, or other harmful code
- Interfere with or disrupt the service or its infrastructure
5. Practice Content
TypingPlace provides typing exercises and practice content for your personal use. If
future features allow custom drills, generated exercises, or account-specific practice
sets, those features will also be governed by this section.
Ownership of Practice Content
Typing drills, practice sessions, and other content provided through TypingPlace (“Practice Content”) are owned by TypingPlace. This includes content created using our templates, algorithms, or by our team and contractors.
You receive a personal, non-exclusive, non-transferable license to use Practice Content for your own typing practice while you use TypingPlace or while your account is active if account features are enabled.
Acknowledgments
By using TypingPlace, you acknowledge and agree that:
- Practice Content is created using TypingPlace’s proprietary tools, systems, methods, or personnel
- Similar or identical content may be provided to other users
- You have no exclusivity rights to Practice Content
- Practice Content is for your personal, non-commercial use only
Your Responsibilities
- You are solely responsible for reviewing and verifying the accuracy of any Practice Content before relying on it
- Practice Content may contain errors, inaccuracies, or inappropriate material
- You must ensure your use of Practice Content does not infringe third-party intellectual property rights
Disclaimer
We do not guarantee that Practice Content is accurate, complete, appropriate, unique, or suitable for any purpose. Practice Content may contain factual errors, offensive language, or other inappropriate content. We are not liable for any reliance you place on such content.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of Practice Content or your violation of these Terms.
6. Badges and Recognition
TypingPlace may introduce badges or other recognition for completing exercises, drills, or achieving typing-skill milestones such as words-per-minute or accuracy thresholds (“Badges”). TypingPlace does not currently offer account-based badges on the public practice site.
Nature of Badges
Badges are informal recognition of your typing practice activity on TypingPlace. They are not:
- Academic credentials, certificates, or diplomas
- Proof of professional typing certification or competency
- Recognized by educational institutions or employers
- Equivalent to formal typing assessments or industry-standard certifications
No Guarantee
Earning a Badge does not guarantee any particular level of typing skill in real-world contexts. Badges reflect participation and completion within TypingPlace, not assessed proficiency.
Use of Badges
You may share your Badges for personal purposes. You may not misrepresent Badges as formal credentials or use them in contexts that imply official certification.
7. Intellectual Property
Our Rights
TypingPlace, including its software, design, features, and branded content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without permission.
Your Rights
You retain ownership of your personal data. For clarity, Practice Content (as defined in Section 5) is owned by TypingPlace, not by you. Our Privacy Policy explains how we handle your personal data.
Trademarks
“TypingPlace” and our logo are our trademarks. You may not use them without our prior written consent.
8. Limitation of Liability
Disclaimer of Warranties
TypingPlace is provided “as is” and “as available” without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that the service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any content
Practice Content Disclaimer
TypingPlace is designed to support typing practice but is not a substitute for formal typing instruction or professional typing assessment.
We do not guarantee that any content on TypingPlace—including official exercises, drills, practice sessions, or any other content—is accurate, complete, appropriate, current, or suitable for any particular purpose. Content may contain:
- Typographical errors or inconsistencies
- Simplified or incomplete instructions
- Variations between keyboard layouts or regional conventions
- Outdated material or expressions
- Content that does not reflect every typing methodology
You are responsible for verifying any information before relying on it for academic, professional, or certification purposes. We are not liable for any consequences arising from inaccuracies in practice content.
Limitation of Damages
To the maximum extent permitted by law:
- Our total liability to you for any claims arising from your use of TypingPlace is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of data, profits, revenue, or business opportunities
Statutory Rights
Nothing in these Terms affects any statutory rights that cannot be waived or limited by contract. If you are a consumer in the European Union, you retain all mandatory consumer protection rights under applicable law.
9. Account Termination
Termination by You
If account features are enabled, you may delete your account through your account settings. Upon deletion, your data will be handled according to our Privacy Policy.
Termination by Us
If account features are enabled, we may suspend or terminate your account if:
- You violate these Terms
- We are required to do so by law
- Your account has been inactive for 24 months or more
For violations other than severe misconduct, we will provide notice and an opportunity to remedy the violation before termination.
Immediate Termination
If account features are enabled, we may terminate your account immediately and without notice for:
- Fraud or illegal activity
- Severe abuse or harassment
- Actions that threaten the security or integrity of our service
- Repeated violations of these Terms
Service Discontinuation
We reserve the right to discontinue TypingPlace entirely. If we do so, we will provide at least 60 days notice to active users.
Effect of Termination
Upon termination, your right to use TypingPlace ends immediately. Provisions that by their nature should survive termination will remain in effect, including intellectual property rights, limitations of liability, and dispute resolution.
10. Changes to Terms
We may update these Terms from time to time. When we make material changes:
- We will notify you by email and/or through an in-app notice
- We will provide at least 30 days notice before changes take effect
- The updated Terms will indicate the “Last Updated” date
Your continued use of TypingPlace after the notice period constitutes acceptance of the updated Terms. If you do not agree to the changes, you may stop using TypingPlace or terminate your account before they take effect if account features are enabled.
11. Dispute Resolution
Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@typingplace.com to attempt to resolve any dispute informally. We will work in good faith to address your concerns within 30 days.
Governing Law
These Terms are governed by the laws of Israel, without regard to conflict of law principles.
Jurisdiction
Any disputes that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.
12. General Provisions
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding TypingPlace.
Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control. This includes, but is not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (such as cloud hosting providers).
If a force majeure event continues for more than 30 days, either party may terminate the agreement by providing written notice.
